RECOMMENDED ACTION:

Monterey Branch Line Easement to Pacific Gas and Electric Company

  1. APPROVE the Easement Purchase Agreement with Pacific Gas and Electric Company regarding a permanent non-exclusive utility easement within the TAMC Monterey Branch Line rail right-of-way near Del Monte Boulevard and Reservation Road in Marina, California for improvements for an existing gas transmission line, subject to approval by legal counsel;
  2. AUTHORIZE the Executive Director to execute the Easement Purchase Agreement and to take such other future actions as may be necessary to fulfill the intent of the Easement Purchase Agreement including approvals of future modifications or amendments that do not significantly alter the terms of the approved Easement Purchase Agreement;
  3. AUTHORIZE the Executive Director to execute a deed granting a permanent non-exclusive utility easement in favor of Pacific Gas and Electric Company to install improvements for an existing gas transmission line; and 
  4. AUTHORIZE the Executive Director to take such other future actions as may be necessary to fulfill the intent of the permanent non-exclusive utility easement including approvals of future modifications or amendments that do not significantly alter the scope of work, or significantly change the approved easement terms or amounts.
SUMMARY:

The Pacific Gas and Electric Company plans to perform improvements along existing gas transmission lines near the intersection of Del Monte Boulevard and Reservation Road in Marina California. To accommodate potential future light rail improvements, PG&E's planned gas line improvements will be moved along Del Monte Boulevard from south of Reservation Road to north of Reservation Road. This relocation of planned improvements will require the grant of a permanent non-exclusive utility easement.

FINANCIAL IMPACT:
The compensation amount of Four Hundred Dollars ($400.00) to be paid to TAMC for the non-exclusive utility easement is based on fair market value.  Once received, these funds will be transferred into the TAMC fund for Monterey Branch Line revenues.
DISCUSSION:

The Pacific Gas and Electric Company (PG&E) is in the process of performing upgrades to their existing gas distribution system throughout the state.  As part of this program, PG&E planned on performing improvements to the existing gas pipeline bridle set along Del Monte Boulevard in Marina, south of Reservation Road.  Based on the Concept Plans for Track Restoration developed by Parsons in 2010, TAMC has planned rail improvements at this location.  Given this, PG&E will be abandoning the proposed improvements along Del Monte Boulevard south of Reservation Road  and installing a new bridle set on the existing gas pipeline along Del Monte Boulevard north of Reservation Road.  In order to perform this work, PG&E requires an easement for that portion of the new bridle set that falls within the TAMC Monterey Branch Line rail right-of-way.

 

An Easement Purchase Agreement has been developed between the Agency and PG&E.  Once the Agreement is fully executed, the conveyance of the non-exclusive utility easement to PG&E can proceed.  The Agreement and grant of easement include the terms and conditions of the easement.
