5.AUTHORIZE the Executive Director to deposit an additional $1,277,560 into the State Condemnation Fund in response to a Superior Court Order directing the Agency to increase the amount of probable compensation on deposit for the acquisition of 21 Happ Place for the Salinas Rail Extension project.

The Superior Court of California issued an Order granting a motion from MWM Investments to increase the amount of probable compensation on deposit for the Agency's partial acquisition of 21 Happ Place to account for costs to restore a warehouse on the remainder property.

2018 Regional Development Impact Fee Nexus Study Update:

  1. RECEIVE an update on the 2018 Regional Development Impact Fee Nexus Study; and
  2. PROVIDE policy direction on the collection of regional fees in the FORA zone in the event FORA sunsets.

The Transportation Agency is required to update the Regional Development Impact Fee every five years. This process includes reviewing the land use and population assumptions in the regional travel demand model, forecasting future travel demands, updating the project list as necessary to meet those demands, revising project costs, and developing an updated fee schedule.

7.APPROVE allocating $154,500 of Regional Surface Transportation Program funds for Metz Road Traffic Calming project in the City of Soledad.

Agency staff is seeking to utilize Regional Surface Transportation Program funds reserved for Complete Streets project implementation to fund additional pedestrian safety features as part of the City of Soledad's Metz Road Traffic Calming project.

2018 Regional Transportation Plan:

  1. ADOPT Resolution 2018-12 to adopt CEQA findings, a Statement of Overriding Considerations, and a Mitigation Monitoring and Reporting Program related to the Environmental Impact Report certified by the Association of Monterey Bay Area Governments for the 2018 Monterey County Regional Transportation Plan; and
  2. ADOPT Resolution 2018-13 to adopt the 2018 Monterey County  Regional Transportation Plan.

The Transportation Agency adopts a Regional Transportation Plan every four years to provide a basis for allocating state and federal funding to transportation projects in Monterey County. The 2018 Plan is intended to be a technical update to the 2014 Plan, reflecting changes in revenue forecasts and updated project lists from the local jurisdictions.The Agency prepares the plan in coordination with the Association of Monterey Bay Area Governments (AMBAG) to be consistent with the regional Sustainable Communities Strategy.

1.ADMINISTRATION and BUDGET
3.1.1

APPROVE minutes of the Transportation Agency for Monterey County (TAMC) The Service Authority for Freeways and Expressways, and the Monterey County Regional Development Impact Fee Joint Powers Agency for May 23, 2018.

ACCEPT the list of checks written for the month of May 2018 and credit card statements for the month of April 2018.

The list of checks and copies of credit card statements are submitted to the Transportation Agency Board each month in accordance with the recommendation from the Transportation Agency’s independent Certified Public Accountant to keep the Board informed about the Transportation Agency’s financial transactions.

3.1.3

RECEIVE report on conferences or trainings attended by agency staff.

Agency staff occasionally attends conferences or trainings at Agency expense that are pertinent to their roles in pursuing the Agency’s mission.  These events allow the staff to stay current and participate in the development of transportation practices and policies related to their roles.

3.1.4APPROVE attached updated Agency weighted vote table.

In accord with Agency Bylaws, staff revised the weighted vote table based on the most current population estimate prepared by the California Department of Finance. Staff revises the weighted vote table annually when the new population estimates are available.

3.1.5

APPROVE closure of Transportation Agency for Monterey County offices on December 26, 27, 28, and 31, 2018.

Transportation Agency for Monterey County generally has minimal staff in the office during the period between Christmas and New Year’s Day. Many of the agencies that staff works with are also either closed or operate with minimal staff during the holiday period noted above. Closing the office will benefit the Agency financially.

3.1.6APPROVE delaying the annual evaluation for the Agency Executive Director and Counsel to December 2019 from December 2018 as recommended by the Executive Committee.

The Transportation Agency bylaws require an annual evaluation of the Executive Director and Counsel. Executive Director Hale’s employment agreement also states that the TAMC Board shall evaluate her by the December Board meeting of each year and Hale shall prepare goals and accomplishments for review by the TAMC Board.

3.1.7

On-Call Graphic Design Consultant:

  1. AUTHORIZE the Executive Director to execute a contract with AMF Media Group, in an amount not to exceed $60,000, to provide on-call consultant services for graphic design of public outreach/marketing documents for two years, June 2018 through June 2020;
  2. APPROVE the use of reserve funds budgeted to this purpose; and
  3. AUTHORIZE the Executive Director to make administrative changes to the contracts if such changes do not increase the Agency’s net cost, subject to approval by Agency counsel.

The Transportation Agency released a Request for Qualifications (RFQ) for on-call consultant(s) for graphic art design of public outreach/marketing documents on March 29, 2018. The Agency received 15 responsive Statements of Qualifications by the deadline. Based upon the criteria established in the Request for Qualifications, ranking and references, staff is recommending AMF Media Group for the on-call graphic designer.

3.1.8

Contract Amendment for Legislative Analyst Services:

  1. APPROVE contract amendment with Khouri Consulting to provide an increase in compensation from $30,000 per year to $36,000 per year based on performance and hours worked; and
  2. AUTHORIZE the Executive Director to execute the contract amendment and changes to the contract if such changes do not increase the Agency's net cost, subject to approval by Agency Counsel.

Gus Khouri of Khouri Consulting has been providing the Agency with superior services since his hiring on July 1, 2018. His accomplishments include diligent advocacy for the Agency's priorities for transportation funding, including grants through the Senate Bill 1 programs.

3.1.9

ADOPT Resolution 2018-10 adopting the Agency's updated Title VI Program and Language Assistance Plan.

Title VI of the Civil Rights Act of 1964 prohibits recipients of federal funds from discriminating on the basis of race, color or national origin in their programs or activities. As a recipient of federal funds, TAMC's Title VI Program and Language Assistance Plan establish a policy of nondiscrimination.

3.1.10APPROVE Resolution 2018-09 providing authority for the Executive Director to execute amendment No. 1 to the fiscal year 2018/19 Overall Work Program and Budget to develop the Monterey County Regional Conservation Investment Strategy.

The Transportation Agency was successful in receiving a Senate Bill 1 Caltrans Adaptation Planning Grant for the Monterey County Regional Conservation Investment Strategy, which will define a framework to finance the implementation of conservation strategies as compensatory mitigation for Measure X regional transportation improvements. This amendment will allow the grant funding to be utilized in the 2018-19 fiscal year.

3.1.11

RECEIVE and ACCEPT a financial report of the Measure X Transportation Safety and Investment Plan receipts and disbursements for the first twelve months from April 2017 through March 2018.

During this period the State Board of Equalization has collected and remitted $26,569,249.54 to the Monterey County Measure X fund and the fund has earned $58,438.67 of interest. During this period initial and onetime fees of $829,418.76, TAMC administrative costs of $195,209.87, Regional Projects and Programs costs of $237,527.20 and $15,304,115.12 of County and Cities 60% shares were disbursed.

2.BICYCLE, PEDESTRIAN, TRANSIT, and SOCIAL SERVICES
3.2.1

State Active Transportation Program Grant Applications

  1. AUTHORIZE staff to submit two State Active Transportation grant applications;
  2. APPROVE the local grant match of $2,272,000 from Measure X; and
  3. AUTHORIZE the Executive Director to accept grant funds, if awarded

Transportation Agency staff is seeking Board authorization to apply for two State Active Transportation Program grants. The first application is to construct a segment of the Fort Ord Regional Trail and Greenway along Canyon Del Rey Boulevard. The second application will install traffic gardens at several locations around the County in coordination with bicycle and pedestrian safety education activities.

3.2.2

ADOPT  Resolution 2018-14 which determines the Monterey County Active Transportation Plan and its proposed improvements were identified and analyzed in the program-level EIR for the 2040 Metropolitan Transportation Plan/Regional Transportation Plan and adopts the Monterey County Active Transportation Plan.

The draft Monterey County Active Transportation Plan was developed with input from partner agencies, stakeholders and community members. The Active Transportation Plan documents existing bike and pedestrian conditions, analyzes demographic and safety data and includes a prioritized list of bike and pedestrian infrastructure improvements throughout the County.

3.2.3

Transportation Development Act Allocation & Unmet Transit Needs:

  1. RECEIVE list of Monterey County's unmet transit needs; 
  2. APPROVE Monterey-Salinas Transit's application for State Transportation Development Act funds; and 
  3. ADOPT Resolution 2018-11 allocating $19,354,476 in Transportation Development Act funds to Monterey-Salinas Transit for Fiscal Year 2018-19.

As the Regional Transportation Planning Agency, TAMC oversees the approval process for allocating State funds devoted to local transit expenditures. TAMC annually seeks public input to identify unmet transit needs in Monterey County, and has coordinated with Monterey-Salinas Transit and its Mobility Advisory Committee to evaluate the unmet transit needs comments received through April 30, 2018.

3.2.4

APPROVE the appointment of Jack Smith representing District 2 to serve on the TAMC Bicycle and Pedestrian Facilities Advisory Committee.

The Board appoints members of the public on an as-needed basis to serve on the  Bicycle and Pedestrian Facilities Advisory Committee to advise staff on bicycle and pedestrian transportation issues and make recommendations to the TAMC Board.

3.PLANNING
3.3.1

ADOPT oppose position on Assembly Bill (AB) 2806 (Olbernolte): Vehicles: disabled parking, and ADOPT support position on Senate Bill (SB) 848 (Committee on Budget): Transportation.

AB 2806 (Obernolte) would allow vehicles with a disabled placard or license plate equipped with a lift or ramp to park in spaces designated for electric vehicles, which would act as a disincentive for jurisdictions to install electric vehicle charging stations. SB 848 (Committee on Budget) would, among other things, cap the amount of indirect cost recovery charges assessed by Caltrans on counties with countywide sales tax measures solely dedicated for transportation purposes, to 10% for a period of three years.

4.PROJECT DELIVERY and PROGRAMMING
3.4.1AUTHORIZE the Executive Director to execute a Senate Bill 1 Local Partnership Program Baseline Agreement to receive grant funding for the Marina-Salinas Multimodal Corridor - Imjin Road Widening Project.

The Transportation Agency and the City of Marina were awarded $19 million in Senate Bill 1 Local Partnership Program Competitive funds for the Marina-Salinas Multimodal Corridor - Imjin Road Widening project.  In order to receive funds, the Agency is required to enter into a Baseline Agreement with the California Transportation Commission.

3.4.2

Monterey County Service Authority for Freeways and Expressways Agreement with the California Highway Patrol:

  1. APPROVE the use of $3,000 in Service Authority for Freeways and Expressways funds for call box program administration by the California Highway Patrol over the three-year contract period; and 
  2. AUTHORIZE Executive Director to execute an agreement with the CHP for call box program administration and to make administrative changes if such changes do not increase the Agency’s net cost, subject to approval by Agency counsel.

Monterey County has a system of 190 call boxes on its highways and county roads to assist stranded motorists and enable them to contact the California Highway Patrol for assistance if necessary.  Since the California Highway Patrol incurs personnel costs in the call box program administration, the contract will allow the Agency, as Service Authority for Freeways and Expressways authority, to reimburse the California Highway Patrol for these costs.

5.RAIL PROGRAM
3.5.1

Salinas Rail Project - Contract for Structure Demolition:

  1. APPROVE and AUTHORIZE the Executive Director to execute contract with Bowen Engineering and Environmental for building demolition for the Salinas Rail Station, Package 1, subject to Agency Counsel and Caltrans approval, in an amount not to exceed $672,000 for the period ending December 31, 2018;
  2. APPROVE the use of funds from the approved project budget for this work in an amount not to exceed $672,000, and $80,000 as a contingency fund for change orders; and
  3. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract terms or amount.

On April 27, 2018, the Agency published bid documents for qualified structure demolition teams to demolish the structures on parcels of land now in TAMC possession near the Salinas train station, in preparation for the construction of Package 1 improvements. Package 1 of the Salinas Rail Extension Kick Start project includes the extension of Lincoln Avenue for signalized access to the train station and circulation and parking improvements. TAMC received two bids, and Bowen Engineering and Environmental is the lowest responsive bidder.

3.5.2

Water Pipeline Easement Appraisal Services Contract:

  1. APPROVE and AUTHORIZE the Executive Director to execute a contract with Overland, Pacific & Cutler, LLC for an amount not-to-exceed $59,393.25, for the period ending June 30, 2020, pending approval by Agency Counsel;
  2. APPROVE the use of California American Water funds per executed reimbursement agreement executed August 11, 2017; and 
  3. AUTHORIZE the Executive Director to take other such further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract term or amount.

TAMC issued a Request for Proposals (RFP) on May 3, 2018 soliciting proposals from qualified firms and sent by email to over 100 firms from the Agency's consultant list. The RFP was posted on the Agency's website during the proposal period and appeared in the Monterey County Weekly newspaper for the week of May 3, 2018. One proposal was submitted by Overland, Pacific & Cutler, LLC on the required due date of May 24, 2018. Staff reviewed the proposal and found it to be responsive to the requirements of the RFP and recommends Board approval of the contract.
