1.QUORUM CHECK – CALL TO ORDER

Transportation Agency by-laws require a quorum of a minimum of 9 voting members, including a minimum of 7 city representatives and 1 county representative.

 

If you are unable to attend, please contact your alternate. Your courtesy to the other Transportation Agency Board members to assure a quorum is appreciated.

2.PUBLIC COMMENTS
Any person may address the Transportation Agency Board at this time.  Presentations should not exceed three minutes, should be directed to an item NOT on today's agenda, and should be within the jurisdiction of the Transportation Agency Board. Though it is not required, the Transportation Agency Board appreciates your cooperation in completing a speaker request form available on the table at the entrance to the meeting room.  Please give the completed form to the Transportation Agency Administrative Assistant. If you have handouts, please provide 30 copies for the entire Board before the meeting starts or email to Agency Administrative Assistant 24 hours in advance of the meeting.
3.CONSENT AGENDA

Approve the staff recommendations for items listed below by majority vote with one motion.  Any member may pull an item off the Consent Agenda to be moved to the end of the CONSENT AGENDA for discussion and action.

4.PRESENT a Certificate of Appreciation to Hunter Harvath, Monterey-Salinas Transit Assistant General Manager, for his many years of service enhancing transportation in the Monterey County area region and beyond.

Hunter Harvath has been with Monterey-Salinas Transit since 2003.  He has represented MST on the TAMC Board of Directors as an ex officio/alternate member, the Technical Advisory Committee, and the Rail Policy Committee.  He has been a key liaison to the business community, and has collaborated with TAMC on numerous initiatives, including the Highway 1 - Rapid Bus Corridor project, Measure X, and the Monterey Branch Line alternatives analysis. He will be retiring from Monterey-Salinas Transit in September, 2019.

PRESENT Transportation Agency Employees of the Quarter to Ariana Green and Stefania Castillo.

Ariana Green, Associate Transportation Planner and Stefania Castillo, Transportation Planner have been selected by the employees of the Transportation Agency for Monterey County as the Employees of the Quarter for April – June 2019.

6.

Canyon Del Rey Blvd (SR 218) Corridor Study Approval

  1. DETERMINE that approval of the Canyon Del Rey Blvd (SR 218) Corridor Study is exempt from the California Environmental Quality Act (CEQA) pursuant to California Resources Code Section 21102, and CEQA Guidelines Section 15262 (feasibility plans);
  2. RECEIVE presentation; and
  3. APPROVE the Canyon Del Rey Blvd (SR 218) Corridor Study.

The Transportation Agency in partnership with the cities of Seaside and Del Rey Oaks and Caltrans conducted a study of the State Route 218 corridor to identify improvements that will provide safer access to all modes of travel. Approving this corridor study allows TAMC and cities to apply for SB1 funding for individual projects.

7.

Commence Process to Amend Measure X Maintenance of Effort Calculation Provision:

  1. INTRODUCE, waive the reading, and set October 23, 2019 at 9:00 a.m. as the date and time to consider the adoption of an ordinance amending the Measure X Ordinance to revise the Maintenance of Effort calculation;
  2. SET a noticed public hearing for September 25, 2019, and
  3. DIRECT staff to publish notice of the public hearing and publicize a 45-day comment period.

The purpose of the Measure X annual audit is to confirm that the funding recipients -- TAMC, the County of Monterey and the twelve incorporated cities -- have complied with the voter-approved requirements specified in Ordinance 2016-01 for the Transportation Safety and Investment Plan, including the “maintenance of effort” requirement. The proposed amendment will change the method for calculating the existing ordinance’s required maintenance of effort to be the greater of the SB 1 requirement, or the amount local funds spent in fiscal year 2016/17, plus an annual growth factor.

Draft 2019 Public Participation Plan

  1. RECEIVE presentation on the Draft 2019 Public Participation Plan;
  2. OPEN public hearing;
  3. RECEIVE public comment; and
  4. CLOSE public hearing.

On June 26, 2019, the Transportation Agency's Board of Directors authorized the release of the 2019 Draft Public Participation Plan for a 45-day public comment review period, and scheduled a public hearing for the plan to take place during the August 28, 2019 Board Meeting.

3.1.1APPROVE minutes of the Transportation Agency for Monterey County (TAMC) the Service Authority for Freeways and Expressways, and the Monterey County Regional Development Impact Fee Joint Powers Agency for June 26, 2019.

3.1.2ACCEPT the list of checks written for June and July 2019 and credit card statements for the months of May and June 2019.

The list of checks and copies of credit card statements are submitted to the Transportation Agency Board each month in accordance with the recommendation from the Transportation Agency’s independent Certified Public Accountant to keep the Board informed about the Transportation Agency’s financial transactions.

3.1.3RECEIVE list of contracts awarded under $50,000.

The list of contracts awarded by the Transportation Agency for Monterey County for services under $50,000 approved by the Executive Director is submitted each month in accordance with the Agency's Procurement Policies to keep the Board informed.

3.1.4

RECEIVE report on conferences or trainings attended by agency staff.

Agency staff attend conferences or trainings at Agency expense that are pertinent to their roles in pursuing the Agency’s mission.  These events allow the staff to stay current and participate in the development of transportation practices and policies related to their roles.

3.1.5APPROVE closure of Transportation Agency for Monterey County offices on December 23, 26 and 27, 2019.

Transportation Agency for Monterey County generally has minimal staff in the office during the period between Christmas and New Year’s Day. Many of the agencies that staff works with are also either closed or operate with minimal staff during the holiday period noted above. Closing the office will benefit the Agency financially.

3.1.6RECEIVE the 2018/19 workforce data analysis for the Voluntary Equal Employment Opportunity Plan.

In 2015, the Agency adopted a Voluntary Equal Employment Opportunity Plan. There is no legal requirement for the Agency to have this plan; however, the voluntary plan supports the Agency’s policy of nondiscrimination in employment practices. Staff updates the workforce data on an annual basis.

3.1.7

APPROVE Resolution 2019-08 providing authority for the Executive Director to execute amendment No. 1 to the fiscal year 2019/20 Overall Work Program and Budget to develop a Salinas Safe Walking and Biking to School Plan.

This amendment will allow state Sustainable Transportation Planning grant funding to be utilized in the current fiscal year for Safe Route to School activities.

2.BICYCLE, PEDESTRIAN, TRANSIT, and SOCIAL SERVICES
3.2.1APPROVE the appointment of Joachim Hofmann Jr. to serve as the City of Marina primary representative on the TAMC Bicycle and Pedestrian Advisory Committee.

The Board appoints members of the public on an as-needed basis to serve on the Bicycle and Pedestrian Facilities Advisory Committee to advise staff on bicycle and pedestrian transportation issues and make recommendations to the TAMC Board.

3.3.1

4.PROJECT DELIVERY and PROGRAMMING
3.4.1

APPROVE proposed changes in the Measure X Citizens Oversight Committee Bylaws.

The Measure X Citizens Oversight Committee's Bylaws were approved by the Transportation Agency's Board of Directors on April 26, 2017. This report seeks to make changes to the term of office for the committee's Chair and Vice Chair, create a new Sub-Committee Audit Chair and clarify the language in other sections of the Measure X Citizens Oversight Committee Bylaws.

3.4.2APPROVE Resolution 2019-07 authorizing the use of $2,489 in Regional Surface Transportation Program funds as the Agency contribution to the 2020 & 2022 Statewide Local Streets and Roads Needs Assessments.

The first comprehensive statewide study of California’s local street and road system in 2008 provided critical analysis and information on the local transportation network’s condition and funding needs and helped to make the case for additional state funding. Conducted biennially, the needs assessment provides another look at this vital component of the state’s transportation system.

5.RAIL PROGRAM
3.5.1RECEIVE the final budget for the partial acquisition of 21 Happ Place.

The Superior Court of Monterey County has entered the final judgement on the partial acquisition of 21 Happ Place.  The amount awarded to MWM Investments is $1,366,252, resulting in a refund to the Transportation Agency of $633,308 from the amount placed on deposit with the State Condemnation Fund.

3.5.2RECEIVE update on activities related to management and development of TAMC’s Fort Ord property along Highway 1 and AUTHORIZE participation in Fort Ord Reuse Authority's building demolition program.

The Transportation Agency owns 12.1 acres of property in the former Fort Ord in the vicinity of Hwy 1 and 8th Street. Seven building built by the Army between 1941 and 1953 are located on the property. Staff is evaluating options to utilize the property including demolition and adaptive reuse. Fort Ord Reuse Authority is pursuing bonding for base-wide building removal.

3.5.3

California American Water Company Pipeline Easements

  1. ADOPT a Resolution determining that the approval of an Easement Purchase Agreement and an Operations Plan and Agreement with California American Water Company for the installation and operation of a water pipeline as part of the Monterey Peninsula Water Supply Program is contained within the scope of the Final EIR/EIS for the Monterey Peninsula Water Supply Project (SCH# 2006101004), and TAMC has reviewed and understood the conditions of that document and has determined that no new environmental analysis is required;
  2. APPROVE the Easement Purchase Agreement and Operations Plan and Agreement with California American Water Company regarding a permanent easement and a series of temporary construction easements to install a water pipeline in the TAMC Monterey Branch Line rail right-of-way;
  3. AUTHORIZE the Executive Director to execute deeds granting a permanent easement and temporary construction easements in favor of California American Water Company to install a water pipeline in the TAMC Monterey Branch Line rail right-of-way;
  4. APPROVE design exceptions to American Railway Engineering and Maintenance-of-Way Association standards requested by California American Water Company; and
  5. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the of the easements including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved easement terms or amounts of compensation, subject to approval by Agency Counsel.

California American Water Company's Monterey Peninsula Water Supply Project was approved by the California Public Utilities Commission (CPUC) on September 13, 2018 (CPUC Decision 18-09-017). As part of the project's implementation, new water pipelines are planned to be installed within Transportation Agency's Monterey Branch Line rail right-of-way from Seaside to Castroville.   This action approves Cal Am's purchase from TAMC of a 20'-25' wide permanent easement in the amount of $693,000, and temporary construction easements to install approximately 50,000' of water pipelines within the Monterey Branch Line rail right-of-way, as detailed below.
