On March 12, 2020, Governor Newsom issued Executive Order N-25-20, which enhances State and Local Governments’ ability to respond to COVID-19 Pandemic based on Guidance for Gatherings issued by the California Department of Public Health.The Executive Order specifically allows local legislative bodies to hold meetings via teleconference and to make meetings accessible electronically, in order to protect public health. In light of this, the March 25, 2020 meeting of the TAMC Board will be held via Zoom conference. There will be NO physical location of the meeting. The public is strongly encouraged to use the Zoom app for best reception. Due to the current circumstances, there may be limited opportunity to provide verbal comments during the meeting. Persons who wish to address the Board for public comment or on an item on the agenda are encouraged to submit comments in writing to TAMC at info@tamcmonterey.org by 5:00 pm on Monday, March 23, 2020; such comments will be distributed to the TAMC Board before the meeting. Members of the public participating by Zoom are instructed to be on mute during the proceedings and to speak only when public comment is allowed, after requesting and receiving recognition from the Chair. 1.QUORUM CHECK – CALL TO ORDER

Transportation Agency by-laws require a quorum of a minimum of 9 voting members, including a minimum of 7 city representatives and 1 county representative.

 

If you are unable to attend, please contact your alternate. Your courtesy to the other Transportation Agency Board members to assure a quorum is appreciated.

PLEDGE OF ALLEGIANCE
2.PUBLIC COMMENTS
Any person may address the Transportation Agency Board at this time.  Presentations should not exceed three minutes, should be directed to an item NOT on today's agenda, and should be within the jurisdiction of the Transportation Agency Board.
3.CONSENT AGENDA

Approve the staff recommendations for items listed below by majority vote with one motion.  Any member may pull an item off the Consent Agenda to be moved to the end of the CONSENT AGENDA for discussion and action.

Fort Ord Regional Trail and Greenway (FORTAG) Final Environmental Document

  1. CERTIFY Final Environmental Impact Report on the Fort Ord Regional Trail and Greenway Project;   
  2. ADOPT the Mitigation Monitoring and Reporting Plan in compliance with Public Resources Code Section 21081.6 and California Environmental Quality Act Guidelines Section 15097;
  3. ADOPT Findings in compliance with Public Resources Code Section 21081 and California Environmental Quality Act Guidelines Section 15091 that changes or alterations have been required in, or incorporated into, the project which avoid or substantially lessen the significant environmental effects as identified in the Final EIR;   
  4. APPROVE the Master Agreement between and among the Transportation Agency and the County of Monterey, the cities of Seaside, Marina, Monterey, Del Rey Oaks, California State University Monterey Bay, University of California Santa Cruz, and Monterey Peninsula Regional Park District; and
  5. AUTHORIZE the Executive Director to sign the Master Agreement.

Approval of the Master Agreement constitutes approval of the Project as described and evaluated in the Environmental Impact Report. The recommended actions are necessary to proceed with the design/engineering and right-of-way work for Phase 1 of the Canyon Del Rey/State Route 218 Segment in a timely manner to meet the state grant requirements. This phase is funded with a state Active Transportation Program grant matched with Measure X funds.

Programming Guidelines & Competitive Grants:

  1. APPROVE the programming of three years (2020/21/22) of fair share formula Regional Surface Transportation Program (RSTP) Funds to the cities and County;
  2. APPROVE setting aside 10% of Regional Surface Transportation Program funds to a TAMC reserve for complete streets; and
  3. APPROVE updated guidelines and application and RELEASE a call for projects to program competitive Transportation Development Act 2% and RSTP funds.

The Transportation Agency periodically programs Regional Surface Transportation Program and Transportation Development Act 2% Bicycle and Pedestrian funds to local projects in both a formula share (fair share) and a competitive program.

The list of checks and copies of credit card statements are submitted to the Transportation Agency Board each month in accordance with the recommendation from the Transportation Agency’s independent Certified Public Accountant to keep the Board informed about the Transportation Agency’s financial transactions.

RECEIVE report on conferences or trainings attended by agency staff.

Agency staff attend conferences or trainings at Agency expense that are pertinent to their roles in pursuing the Agency’s mission.  These events allow the staff to stay current and participate in the development of transportation practices and policies related to their roles.

3.1.4ACCEPT the Agency's Financial Audit Reports for fiscal year ending June 30, 2019.

For all of the audits completed for the year ending June 30, 2019, the auditors found no instances of noncompliance that are required to be reported under Government Auditing Standards, nor did they note any matters involving the internal control over financial reporting and its operation that they consider to be material weaknesses.

The list of contracts awarded by the Transportation Agency for Monterey County for services under $50,000 approved by the Executive Director is submitted each month in accordance with the Agency's Procurement Policies to keep the Board informed.

2.BICYCLE, PEDESTRIAN, TRANSIT, and SOCIAL SERVICES
3.2.1APPROVE Resolution 2020-04 designating the Transportation Agency's allocation of $814,702 for FY 2019/20 Low Carbon Transit Operation funds to the Monterey-Salinas Transit District for free fares on the weekends on routes that serve disadvantaged communities in Salinas, free monthly youth passes, free fares for Hartnell College and Monterey Peninsula College students, and discounted hospitality group transit passes.

The California Legislature established the Low Carbon Transit Operations Program to distribute cap and trade funds to implement transit priority projects that reduce greenhouse gas emissions, with a priority on serving disadvantaged communities. Program funds are distributed to regional transportation planning agencies based on population and to transit agencies based on transit operator revenues. The Transportation Agency's allocation of Program funds is $814,702 and Monterey-Salinas Transit's allocation is $282,124 for a Monterey County total of $1,096,826.

3.3.1

RECEIVE update on state legislative activities and ADOPT positions on legislation.

The Executive Committee recommends the Board take positions on several bills in the attached draft bill list.

3.3.2

Graphic Design for Public Outreach and Marketing Materials

  1. APPROVE Request for Qualifications (RFQ) for consultant graphic design work of the Transportation Agency's public outreach/marketing documents, subject to counsel approval;
  2. AUTHORIZE staff to publish the RFQ, and return to the Board of Directors with a recommendation for approval of a consultant; and
  3. APPROVE the use of funds from the Agency's approved budget for this contract in an amount not-to-exceed $90,000.

The Transportation Agency is seeking to release a Request for Qualifications from qualified consultants for graphic design services of the Agency's outreach and marketing documents.

4.PROJECT DELIVERY and PROGRAMMING
3.4.1

AUTHORIZE the Executive Director to execute contract amendment #1 with KNN Public Finance to continue providing Measure X financial advisory services through the period ending June 30, 2023.

With the passage of Measure X, the Agency requires the services of a certified financial advisor to review and provide guidance on issues including, but not limited to, goal setting, bonding strategies, investments, and cash flow projections.  The Transportation Agency's existing contract with KNN Public Finance expires on June 30, 2020 and staff is seeking to extend the term of the agreement until December 31, 2023 with no change to the approved budget.
