PRESENT Transportation Agency Employee's of the Quarter to Dave Delfino and Madilyn Jacobsen.

Dave Delfino, Director of Finance/ Analyst and Madilyn Jacobsen, Transportation Planner have been selected by the employees of the Transportation Agency for Monterey County as the Employees of the Quarter for April-June 2020.

5.RECEIVE presentation on revised Measure X revenue forecasts.

Due to the shelter-in-place order, sales of many taxable goods have declined.  As a result, according to revised estimates from the Transportation Agency's sales tax forecasting consultant, HdL Companies, Measure X sales tax revenues will fall below prior projections. The most recent revised projections show a slight improvement for fiscal year 2020/21.

ADOPT Resolution 2020-08 programming $10.547 million of 2020 Competitive Grant funding for fiscal years 2020/21 through 2022/23 and deprogramming $1.3 million of funding from competitively awarded projects from prior cycles that have been completed with balances remaining or exceeded the timely use of funds policy.

The Transportation Agency Board approved releasing a call for projects for a new cycle of competitive grants at its March 2020 meeting. The grant applications were due June 1, 2020. Agency staff established an ad hoc committee of Bicycle & Pedestrian Facilities Advisory and Technical Advisory Committee members to review and rank the applications and provide funding recommendations.  That list of recommended projects is provided in this staff report.

1.ADMINISTRATION and BUDGET
3.1.1APPROVE minutes of the Transportation Agency for Monterey County (TAMC) the Service Authority for Freeways and Expressways, and the Monterey County Regional Development Impact Fee Joint Powers Agency for June 24, 2020.

3.1.2

ACCEPT the list of checks written for June and July 2020 and credit card statements for the months of May and June 2020.

The list of checks and copies of credit card statements are submitted to the Transportation Agency Board each month in accordance with the recommendation from the Transportation Agency’s independent Certified Public Accountant to keep the Board informed about the Transportation Agency’s financial transactions.

3.1.3RECEIVE list of contracts awarded under $50,000.

The list of contracts awarded by the Transportation Agency for Monterey County for services under $50,000 approved by the Executive Director is submitted each month in accordance with the Agency's Procurement Policies to keep the Board informed.

3.1.4APPROVE closure of Transportation Agency for Monterey County offices on December 28, 29, 30 and 31, 2020.

Transportation Agency for Monterey County generally has minimal staff in the office during the period between Christmas and New Year’s Day. Many of the agencies that staff works with are also either closed or operate with minimal staff during the holiday period noted above. Closing the office will benefit the Agency financially.

3.1.5RECEIVE the 2019/20 workforce data analysis for the Voluntary Equal Employment Opportunity Plan.

In 2015, the Agency adopted a Voluntary Equal Employment Opportunity Plan. There is no legal requirement for the Agency to have this plan; however, the voluntary plan supports the Agency’s policy of nondiscrimination in employment practices. Staff updates the workforce data on an annual basis.

3.1.6AUTHORIZE the Executive Director to execute contract amendment #1 with Alvarez Technology Group to increase the budget by $3,735 over five years to cover higher Microsoft Azure subscription costs.

The Transportation Agency uses Microsoft Azure as our cloud-based server.  The Azure service is billed based on network usage, and the service costs have been slightly higher than anticipated in the original contract. This amendment would increase the budget to cover this cost.

3.1.7RECEIVE report on the most current COVID-19 Protection Protocols and APPROVE one-time benefit related to COVID-19 as recommended by the Executive Committee.

Agency staff is working to keep the COVID-19 Protection Protocols current to ensure that the return-to-office after telecommuting for several months is done in a safe and healthy manner for employees and visitors. An additional sell-back of 40.0 hours of accrued vacation is proposed since employees may be unable to take time-off due to the extra work/cancellation of vacation plans caused by the crisis.

2.BICYCLE, PEDESTRIAN, TRANSIT, and SOCIAL SERVICES
3.2.1AUTHORIZE the Executive Director to enter into a Cooperative Agreement with Caltrans to complete the final design and right-of-way review process for the Highway 218 segment of the Fort Ord Regional Trail and Greenway project.

Caltrans requires a Cooperative Agreement with the Transportation Agency to complete the final design and right-of-way review process for the Highway 218 segment of the proposed Fort Ord Regional Trail and Greenway (FORTAG) project. The Cooperative Agreement outlines the duties of Caltrans and of TAMC in order to complete the design and right-of-way review.

3.2.2APPROVE the appointment of Miranda Taylor to serve as the Association of Monterey Bay Area Governments (AMBAG) primary representative on the TAMC Bicycle and Pedestrian Facilities Advisory Committee.

The Board appoints agency representatives on an as-needed basis to serve on the Bicycle and Pedestrian Facilities Advisory Committee to advise staff on bicycle and pedestrian transportation issues and make recommendations to the TAMC Board.

3.2.3

Federal Funds for Rural Transit - Coronavirus Aid, Relief, and Economic Security Act Phase 2:

  1. APPROVE the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) for Federal Transit Administration Section 5311 Program Phase 2 in the amount of $1,325,495  for Monterey-Salinas Transit service on rural transit routes and on-call services;
  2. ADOPT Resolution 2020-09  authorizing funding under the CARES Act Federal Transit Administration Section 5311 Program Phase 2; and
  3. RATIFY the signed Regional Agency Certifications and Assurances for the program of projects.

The Federal Transit Administration provides operating support for rural transit services through the Section 5311 non-urbanized funding program. The Coronavirus Aid, Relief and Economic Security Act funds include support for transit operations and is being distributed in part through the Section 5311 program. TAMC's approval is necessary for Monterey-Salinas Transit to receive this Section 5311 funding to support Line 23 and on-call services in rural Monterey County. The Certifications and Assurances were already signed due to the August 13th application deadline.

3.2.4

Transportation Development Act Allocation & Unmet Transit Needs:

  1. RECEIVE list of Monterey County's unmet transit needs;
  2. APPROVE Monterey-Salinas Transit's application for State Transportation Development Act funds; and
  3. ADOPT Resolution 2020-10 allocating a total of $22,193,789 in Transportation Development Act funds to Monterey-Salinas Transit, composed of $16,995,417 in Local Transportation Funds and $5,198,372 in State Transit Assistance funds for Fiscal Year 2020-21.

As the Regional Transportation Planning Agency, TAMC oversees the approval process for allocating State funds devoted to local transit expenditures. TAMC annually seeks public input to identify unmet transit needs in Monterey County, and has coordinated with Monterey-Salinas Transit and its Mobility Advisory Committee to evaluate the unmet transit needs comments received through May 30, 2020.

3.PLANNING
3.3.1

RECEIVE update on state and federal legislative activities and RATIFY Executive Committee adoption of positions on legislation on behalf of the Board of Directors.

Attached are an updated bill list and an update on state and federal legislative activities.

3.3.2

State Legislative Advocate Services:

  1. APPROVE a Request for Qualifications for state legislative assistance, subject to counsel approval;
  2. AUTHORIZE staff to publish the Request for Qualifications and return to the Board with a recommendation for approval of a consultant; and
  3. APPROVE the use of reserve funding for this contract in an amount not to exceed $48,000 per year for a three-year contract ending October 31, 2023, with the option to extend for one year.

The Agency has employed the services of a state legislative analyst/advocate since 1999 to assist with requesting state funds for transportation projects in Monterey County and seeking other state actions. The current contract expires on October 31, 2020. Staff requests authorization to release a Request for Qualifications for state legislative assistance starting in 2020/21 for three years and the option for a one-year renewal, for a total contract cost of $144,000-$192,000.

3.3.3

Monterey County Regional Conservation Investment Strategy

  1. APPROVE the release of the technical draft of the Monterey County Regional Conservation Investment Strategy; and
  2. DIRECT the Executive Director to submit the technical draft to the California Department of Fish and Wildlife for the required completeness review and public comment period.

The Monterey County Regional Conservation Investment Strategy (RCIS) identifies conservation strategies with co-benefits to transportation infrastructure climate resiliency and public safety, and then proposes ways to implement those strategies as advance mitigation for the transportation improvements. The technical draft of the Strategy is ready for release and submission to the California Department of Fish and Wildlife.

4.PROJECT DELIVERY and PROGRAMMING
3.4.1

Regional Surface Transportation Program Fair Share Allocation:

  1. APPROVE the request by the City of Carmel to program Regional Surface Transportation Program fair share funds to the following projects:
    • Mission Street Sidewalk Reconstruction project in the amount of $15,310.79;
    • City-wide Traffic Striping project in the amount of $15,000; and
    • Electric Vehicle Charging Stations in the amount of $10,000
  2. APPROVE amending Exhibit A of the local funding agreement to include these projects and funding.

The Agency has distributed Regional Surface Transportation Program fair share funding by population to the local jurisdictions for a wide range of eligible transportation projects.  Funding is available at the discretion of the local jurisdiction for their chosen projects, upon approval by the Transportation Agency Board.

3.4.2

Regional Surface Transportation Program Fair Share Allocation:

  1. APPROVE the request by the City of Monterey to program Regional Surface Transportation Program fair share funds to the "Traffic System, Pedestrian and Bike Upgrades" project in the amount of $431,352.19; and
  2. APPROVE amending Exhibit A of the local funding agreement to include these projects and funding.

3.4.3

Roundabout Design Peer Review Contract Amendment:

  1. APPROVE and AUTHORIZE the Executive Director to execute a contract amendment with GHD, a California Corporation, subject to approval by Agency Counsel, to increase the contract by a total amount of $116,000 from $640,000 to $756,000 to provide additional engineering design services;
  2. APPROVE the use of Measure X funds budgeted to the SR 68 Scenic Highway Improvement project and the SR 156 / Castroville Boulevard Interchange project; and
  3. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract amendment, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved agreement term or amount.

Additional consultant services beyond the approved contract are necessary for two on-call task orders. Task Order 1 supports grant applications and prepares Intersection Control Evaluations for the SR 156/Castroville Blvd Interchange project. Task Order 2 increases consultant support for public outreach meetings for the SR 68 Salinas-Monterey Corridor project.

3.4.4

APPROVE the appointment of Cal State University, Monterey Bay student, Natalie Olivas, to serve as the alternate youth representative  on the Measure X Transportation Safety & Investment Plan Citizens Oversight Committee.

The Transportation Safety & Investment Plan Policies calls for the formation of a Citizens Oversight Committee representing a diverse range of community interests. Representatives of these interests must be nominated by their organizations and appointed to serve on the Citizens Oversight Committee by the Transportation Agency’s Board of Directors.

3.4.5AUTHORIZE the use of $ 100,000 from State Freeway Service Patrol and Service Authority for Freeways and Expressways funding to continue temporary services.

The Agency currently operates the Freeway Service Patrol with four beats on three road segments.  Beat 1 operates on Highway 101 from Airport Boulevard in Salinas to the San Benito County line.  Beat 2 operates on State Route 1 from Rio Road in Carmel to Highway 183 in Castroville.  Existing work orders provide temporary service on two beats: Beat 3 on Highway 101 serving traffic from Airport Boulevard in Salinas to Main Street in Chualar, and Beat 4 (non-tow service truck) along the State Route 1 Beat 2 from Rio Road in Carmel to Highway 183 in Castroville.

5.RAIL PROGRAM
3.5.1

Salinas Rail Project Negotiations:

  1. APPROVE a Request for Qualifications for negotiation assistance on the Rail Extension to Monterey County project, subject to counsel approval;
  2. AUTHORIZE staff to publish the Request for Qualifications and return to the Board with a recommendation for approval of a consultant; and
  3. APPROVE the use of reserve funding for this contract in an amount not to exceed $350,000 over three fiscal years, FY 20/21-22/23.

The attached Request for Qualifications seeks qualified consultants for rail negotiations and strategy advice for the Monterey County Rail Extension project

3.5.2

Salinas Rail Project - MNS Engineers Contract Amendment #1:

  1. APPROVE and AUTHORIZE the Executive Director to execute contract amendment #1 with MNS Engineers, subject to approval by Agency Counsel, to increase the budget for construction management of the Monterey County Rail Extension project by $106,377 for a new total contract budget of $4,417,482;
  2. AUTHORIZE the use of state funds budgeted to this project;
  3. FIND that this amendment is justified as a sole source due to the efficiencies that support award to the existing consultant as a logical follow-on to work already in progress under a competitively awarded contract; and
  4. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract term or amount.

The Monterey County Rail Extension Kick Start Project is in the final design phase and Package 1 (Lincoln Avenue Extension and circulation improvements at the Salinas train station) is under construction now. MNS Engineers was originally hired to conduct construction management for all three Packages of the Kick Start project in December 2017 after a formal Request for Proposals process. The contract amendment is being requested to increase the budget to cover additional working days due to unanticipated time spent on utility work and change orders.

6.REGIONAL DEVELOPMENT IMPACT FEE
3.6.1

APPROVE the 2020 Strategic Expenditure Plan Update for the Regional Development Impact Fee program.

In 2008, the 12 cities and the County of Monterey adopted a Joint Powers Agreement establishing a countywide Regional Development Impact fee to mitigate the impact of new development on, and fund improvements to, the regional transportation system.  TAMC administers the fee program and prepares an annual  Strategic Expenditure Plan that includes updated project cost estimates, revenue forecasts, other matching funds, and a draft timeline for project delivery.
