1.QUORUM CHECK – CALL TO ORDER

Transportation Agency by-laws require a quorum of a minimum of 9 voting members, including a minimum of 7 city representatives and 1 county representative.

Any member of the public may address the Board on any item not on the agenda but within the jurisdiction of the Board. Under this item, each member of the public is allowed three minutes to address concerns. Comments in items on this agenda may be given when that agenda item is discussed. Persons who wish to address the Board for public comment or on an item on the agenda are encouraged to submit comments in writing to Maria at maria@tamcmonterey.org by 5:00 pm the Monday before the meeting, and such comments will be distributed to the Board before the meeting.
3.CONSENT AGENDA

4.RECEIVE update on federal legislative activities.

TAMC federal legislative analyst Paul Schlesinger, Alcalde & Fay, will present an update on federal legislative activities.

RECEIVE preliminary concepts of the US 101- South of Salinas corridor study and AUTHORIZE staff to conduct public outreach on the corridor study to collect input on the project.

US 101 between the Chualar interchange and the Airport Boulevard interchange in the City of Salinas has several at-grade intersections that directly serve side roads. Transportation Agency staff is working with Caltrans, City of Salinas, County of Monterey, and the South of Salinas (SOS) US 101 Traffic Safety Alliance to study options to improve safety along this busy agricultural route. The study will consider removing the at-grade uncontrolled exit and entrance points along US 101, upgrading existing interchanges, and utilizing a network of frontage roads to serve the rerouted traffic. The highest priority is to eliminate at-grade left turns across the expressway. The study team is ready to conduct public outreach to share design options that address the safety issues along this corridor.

6.REVIEW and COMMENT on the proposed racial equity program for the Transportation Agency.

In November 2021, Agency staff participated in a three-part training with the County of Monterey's Civil Rights Office. The training provided data that shows that race is a leading determinant of negative economic outcomes in a community, often due to underinvestment or historical bias. Staff has prepared a draft program to integrate specific racial equity-based activities into three Transportation Agency activity areas:  funding, public outreach and hiring.

3.1.1APPROVE the Transportation Agency for Monterey County Board draft minutes of May 26, 2021.

ACCEPT the list of checks written for the month of May 2021 and credit card statements for the month of April 2021.

The list of checks and copies of credit card statements are submitted to the Transportation Agency Board each month in accordance with the recommendation from the Transportation Agency’s independent Certified Public Accountant to keep the Board informed about the Transportation Agency’s financial transactions.

3.1.3

RECEIVE report on conferences or trainings attended by agency staff.

Agency staff attend conferences or trainings at Agency expense that are pertinent to their roles in pursuing the Agency’s mission.  These events allow the staff to stay current and participate in the development of transportation practices and policies related to their roles.

3.1.4

Title VI and Language Assistance Plan

  1. ADOPT Resolution 2021-09 adopting the Agency's updated Title VI Program and Language Assistance Plan; and 
  2. AUTHORIZE the Executive Director to make administrative modifications to the Plan, execute and file all certifications of assurances, contracts and/or agreements required in execution and implementation of the Title VI Plan.

Title VI of the Civil Rights Act of 1964 prohibits recipients of federal funds from discriminating on the basis of race, color or national origin in their programs or activities. As a recipient of federal funds, TAMC's Title VI Program and Language Assistance Plan establish a policy of nondiscrimination.

3.1.5APPROVE attached updated Agency weighted vote table.

In accord with Agency Bylaws, staff revised the weighted vote table based on the most current population estimate prepared by the California Department of Finance. Staff revises the weighted vote table annually when the new population estimates are available.

3.1.6

Executive Director Employment Agreement Amendment No. 1

  1. APPROVE Amendment 1 to the Employment Agreement between the Transportation Agency for Monterey County and Debra L. Hale; and
  2. AUTHORIZE the Chair of the Board of Directors to sign Amendment 1.

Executive Director Debra L. Hale has notified the Board of Directors of her intention to retire in 2021. Ms. Hale’s employment agreement with TAMC expires on June 30, 2021. The Board of Directors has requested she continue her employment with TAMC to overlap with the hiring of a replacement, and thus, a short extension of the agreement is necessary, by way of an amendment.

3.1.7APPROVE delaying the annual evaluation for the Agency Executive Director and Counsel to 2022 from June 2021 as recommended by the Executive Committee.

The Transportation Agency bylaws require an annual evaluation of the Executive Director and Counsel. However, since Executive Director Hale will be retiring this year, it is recommended that the evaluation not be done in 2021. TAMC Counsel Katherine Hansen was recently appointed to this position and there has not been sufficient time to evaluate her performance.

2.BICYCLE, PEDESTRIAN, TRANSIT, and SOCIAL SERVICES
3.2.1

RECEIVE list of Monterey County's unmet transit needs.

In its role as the Transportation Development Act fund administrator, the Transportation Agency annually seeks public input to identify unmet transit needs in Monterey County prior to allocating Local Transportation Funds. Staff coordinated with Monterey-Salinas Transit and its Mobility Advisory Committee to evaluate the unmet transit needs comments received through April 30, 2021.

4.PROJECT DELIVERY and PROGRAMMING
3.4.1

Senate Bill 743 Technical Assistance - Contract Amendment

  1. APPROVE and AUTHORIZE the Executive Director to execute contract amendment #2 with Kimley-Horn Associates to extend the deadline by six months from June 30, 2021 to December 31, 2021 to complete the Senate Bill 743 Technical Assistance for Vehicle Miles Traveled Threshold Development; and
  2. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract term or amount.

The technical assistance has been completed for the cities that participated in this contract. However, coordination is on-going with Monterey County. The proposed contract amendment will extend the timeline from June 30, 2021 through December 31, 2021, with no changes to the contract's not to exceed amount of $130,310.

3.4.2

Regional Pedestrian and Bicycle Wayfinding Call for Construction Bids:

  1. APPROVE the draft Notice to Bidders, Special Provisions, Bid Forms and Plans for construction of Regional Pedestrian and Bicycle Wayfinding Signs, subject to Agency Counsel approval;
  2. AUTHORIZE the Executive Director to publish the final bid documents and any addenda, and return to the Board of Directors with a recommendation for approval of a contract with the lowest responsive responsible bidder; and
  3. APPROVE the use of construction funds from the approved project budget for this work in an amount not to exceed $735,000, included in the $887,000 allocation approved by the California Transportation Commission at their December 2020 meeting, plus local matching funds.

The Notice to Bidders, Special Provisions and Bid Forms, in conjunction with the project plans, enable the Agency to seek construction bids from qualified contractors to furnish and install pedestrian and bicycle wayfinding signs throughout Monterey County.

3.4.3

Regional Surface Transportation Program Fair Share Allocation:

  1. APPROVE the request by the City of Marina to program Regional Surface Transportation Program fair share funds to the Del Monte Boulevard Extension Project in the amount of $303,807.71; 
  2. APPROVE amending Exhibit A of the local funding agreement to include these projects and funding.

The Agency has distributed Regional Surface Transportation Program fair share funding by population to the local jurisdictions for a wide range of eligible transportation projects.  Funding is available at the discretion of the local jurisdiction for their chosen projects, upon approval by the Transportation Agency Board.

5.RAIL PROGRAM
3.5.1

Monterey Branch Line Easement to Pacific Gas and Electric Company

  1. APPROVE the Easement Purchase Agreement with Pacific Gas and Electric Company regarding a permanent non-exclusive utility easement within the TAMC Monterey Branch Line rail right-of-way near Del Monte Boulevard and Reservation Road in Marina, California for improvements for an existing gas transmission line, subject to approval by legal counsel;
  2. AUTHORIZE the Executive Director to execute the Easement Purchase Agreement and to take such other future actions as may be necessary to fulfill the intent of the Easement Purchase Agreement including approvals of future modifications or amendments that do not significantly alter the terms of the approved Easement Purchase Agreement;
  3. AUTHORIZE the Executive Director to execute a deed granting a permanent non-exclusive utility easement in favor of Pacific Gas and Electric Company to install improvements for an existing gas transmission line; and 
  4. AUTHORIZE the Executive Director to take such other future actions as may be necessary to fulfill the intent of the permanent non-exclusive utility easement including approvals of future modifications or amendments that do not significantly alter the scope of work, or significantly change the approved easement terms or amounts.

The Pacific Gas and Electric Company plans to perform improvements along existing gas transmission lines near the intersection of Del Monte Boulevard and Reservation Road in Marina California. To accommodate potential future light rail improvements, PG&E's planned gas line improvements will be moved along Del Monte Boulevard from south of Reservation Road to north of Reservation Road. This relocation of planned improvements will require the grant of a permanent non-exclusive utility easement.

3.5.2

Salinas Rail Project - HDR Engineering Contract Amendment #9:

  1. APPROVE and AUTHORIZE the Executive Director to execute contract amendment #9 to extend the deadline by six months from June 30, 2021 to December 31, 2021, to complete the design work for Package 1 at the Salinas train station; and
  2. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract term or amount.

The Salinas Rail Extension Kick Start Project, package 1 (Salinas Station area improvements) is in the construction and final design phase. HDR Engineering, Inc. was originally hired for this work in June 2014 after a formal Request for Proposals process. The contract now needs to be amended to add time to the contract to complete the project final design, due to the longer timeframe now anticipated for the close-out of that construction project.

3.5.3

Rail Network Integration Study Contract Amendment #1:

  1. APPROVE and AUTHORIZE the Executive Director to execute contract amendment #1 with AECOM, to extend the deadline by six months from June 30, 2021 to December 31, 2021, to complete the Monterey Bay Area Rail Network Integration Study; and
  2. AUTHORIZE the Executive Director to take such other further actions as may be necessary to fulfill the intent of the contract, including approvals of future modifications or amendments that do not significantly alter the scope of work, or change the approved contract term or amount.

The Monterey Bay Area Rail Network Integration Study has been drafted for Board review. Due to a delay in completion of the Caltrans ridership estimates, Caltrans approved a time extension on the Transit and Intercity Rail Capital Program funds allocated for this study. The time is needed to do public outreach on the draft study and to finalize the study. AECOM was originally hired for this work in April 2019 after a formal request for proposals process.

Remote Meetings: On March 12, 2020, Governor Newsom issued Executive Order N-25-20, which enhances State and Local Governments ability to respond to COVID-19 Pandemic based on Guidance for Gatherings issued by the California Department of Public Health. The Executive Order specifically allows local legislative bodies to hold meetings via teleconference and to make meetings accessible electronically, in order to protect public health.
